“Washington is working to push through contracts for tens of billions of dollars in arms sales to Saudi Arabia, some new, others in the pipeline, ahead of U.S. President Donald Trump’s trip to the kingdom this month, people familiar with the talks told Reuters this week.”

Trump is Hiring Lobbyists and Top Ethics Official Says ‘There’s No Transparency’

In one case, an official working on energy regulation recently lobbied for oil and coal companies — but the White House won’t say whether he received an ethics waiver.

President Trump has stocked his administration with a small army of former lobbyists and corporate consultants who are now in the vanguard of the effort to roll back government regulations at the agencies they once sought to influence, according to an analysis of government records by the New York Times in collaboration with ProPublica.

The Times adds new details to our previous reporting on Trump’s weakening of ethics rules and former lobbyists working on regulations they opposed on behalf of private clients just months ago.

Jared Kushner, senior adviser to the president for strategic planning

Kushner, perhaps the most influential aide in the White House, has one of the largest fortunes, thanks to his family’s real estate firm. His filing also shows he has up to $95 million in borrowed money, much of it in the form of unsecured lines of credit held jointly with his father, from lenders including Deutsche and one of Israel’s largest banks, Israel Discount Bank. And he also has two Visa credit cards that together had liabilities of between $115,002 and $300,000, with interest rates of 13.74 percent.

Kushner lists Observer Media, the owner of the New York Observer, as effectively worthless (or worth less than $1,001). Kushner bought the paper for $10 million in 2006, when he was 25. Kushner said in January he would sell the paper into a family trust. On the disclosure, he said the company made $4.5 million in advertising revenue last year.

Ivanka Trump and Jared Kushner Still Benefiting From Business Empire, Filings Show

Ivanka Trump and Jared Kushner, President Trump’s daughter and son-in-law, will remain the beneficiaries of a sprawling real estate and investment business still worth as much as $740 million, despite their new government responsibilities, according to ethics filings released by the White House Friday night.

Ms. Trump will also maintain a stake in the Trump International Hotel in Washington, D.C. The hotel, just down the street from the White House, has drawn protests from ethics experts who worry that foreign governments or special interests could stay there in order to curry favor with the administration.

It is unclear how Ms. Trump would earn income from that stake. Mr. Kushner’s financial disclosures said that Ms. Trump earned between $1 million and $5 million from the hotel between January 2016 and March 2017, and put the value of her stake at between $5 million and $25 million.

The disclosures were part of a broad, Friday-night document release by the White House that exposed the assets of as many as 180 senior officials to public scrutiny. The reports showed the assets and wealth of senior staff members at the time they entered government service.

For the eighth weekend in a row, President Trump has visited a property that bears his name. He has done so on 21 of the 66 days he has been in office, meaning that for the equivalent of three full weeks of his just-over-nine weeks as commander in chief, he has spent all or part of a day at a Trump property — earning that property mentions in the media and the ability to tell potential clients that they might be able to interact with the president. And, despite his insistence on the campaign trail that he would avoid the links — “I’m going to be working for you. I’m not going to have time to go play golf,” he said in August — he has made 13 visits to his own golf courses since becoming president, likely playing golf on at least 12 of those occasions.

Trump plans to unveil a new White House office on Monday with sweeping authority to overhaul the federal bureaucracy and fulfill key campaign promises — such as reforming care for veterans and fighting opioid addiction — by harvesting ideas from the business world and, potentially, privatizing some government functions.

The White House Office of American Innovation, to be led by Jared Kushner, the president’s son-in-law and senior adviser, will operate as its own nimble power center within the West Wing and will report directly to Trump. Viewed internally as a SWAT team of strategic consultants, the office will be staffed by former business executives and is designed to infuse fresh thinking into Washington, float above the daily political grind and create a lasting legacy for a president still searching for signature achievements.

In the Public Interest: Reason and Justice Address Realities

It is not just Donald Trump whose rhetoric is chronically bereft of reality. Politicians, reporters, commentators and academics are often similarly untethered to hard facts, albeit not for narcissistic enjoyment. There are many patterns of fact, relevant to a subject being discussed, that are off the table—either consciously or because they are deemed inconvenient. Rarely are there omissions due to the facts being hard to get or inaccessible.

That in mind, here are a few examples that warrant our scrutiny:

Consider the immense public attention to health insurance and health care and the recent struggles over Obamacare and now Ryancare. Conspicuously absent from the dialogues that pundits, politicians and reporters carry on is that the third leading cause of death in the U.S. is “medical error.” According to a Johns Hopkins University School of Medicine report last May, over 250,000 people lose their lives yearly in U.S. hospitals from “diagnostic errors, medical mistakes and the absence of safety nets” to stop hospital-induced infections, incompetent personnel, dangerous mixes of prescribed drugs and more. Yet in the debate surrounding the health care industry, this huge annual human casualty toll is unmentioned and, for many, intentionally “off the table.”

From a financial perspective, all the coverage of the costs of health insurance and health care excludes at least an estimated $340 billion (according to, among other sources, the leading expert, Professor Malcolm Sparrow of Harvard University) lost annually as a result of computerized billing fraud and abuses—expenses for which taxpayers and consumers must eventually pay. All of this is “off the table.”

Despite all the attention currently being paid to Trump’s proposed $54 billion increase to the military budget, media coverage nonetheless neglects to mention the immense waste, fraud and redundancies already embedded in the roughly $600 billion that account for the Pentagon’s direct annual budget.

A mass of Government Accountability Office (GAO) reports for the Congress, Pentagon audits, and reports by reliable citizen groups regularly document this immense waste. Specifically, the annual cost of the anti-ballistic missile defense program in the Pentagon is over $9 billion—about the same as the budget of the lifesaving Environmental Protection Agency (EPA) that Trump wants to cut by almost a third.

The anti-missile defense technology taxpayers are paying Raytheon and other defense contractors to work on is unworkable. Who says anti-missile defense programs are ineffective? The American Physical Society—more than a few of whom consult with the Department of Defense—as well as the very knowledgeable MIT professor Theodore A. Postol in his Congressional testimony, and the Union of Concerned Scientists.

Along with numerous other infirmities of this boondoggle, it is too easy to decoy the ballistic missiles, not to mention alternative ways for adversaries to endanger our country without signaling a return address as ballistic missiles would. Yet year after year, starting with Ronald Reagan, the money is automatically doled out uncritically by the Congress, backed by its generous contractors’ lobby, deeply entrenched in a system of unaccountable corporate welfare. For the gigantic Pentagon budget is unauditable, according to the GAO.

The Israeli/Palestinian struggle, when hostilities burst forth, is reported routinely as being one started by Palestinian “terrorists” versus Israeli defenders and retaliators. Little emphasized is the reality that the Israeli government is the illegal occupier, colonizer, invader and resource exploiter of the remaining Palestinian lands. Almost never mentioned is that, since 2000, the overwhelming majority of fatalities and injuries in the conflict have been innocent Palestinian civilians, including many children, at the hands of the powerful Israeli military.

Of course, readers can come up with their own examples arising out of local, state, national and international issues. When constantly subjected to a media and political system driven by distraction, one can’t help but ask the question, “Why are they focusing on this instead of that?” One reliable answer is that the powers-that-be work overtime to exclude such embarrassing realities, to assure that, as with corporate crime waves, they’re often not even counted or measured.

If you want a continuing frenzy of reality-exclusion, look no further than the Republicans and their forked tongues. They’re always complaining about deficits, while cutting taxes for corporations and the wealthy, overlooking real problems they pay lip service to such as “government waste.”

But here is what takes the cake. For six years the Republican House of Representatives has been slicing off more and more of the Internal Revenue Service’s slim budget. With Republicans now controlling both houses of Congress, they want to drive it below $10 billion for next year. Apart from resulting in your waiting forever to get someone from the IRS on the phone to answer your questions, there is the modest result of over $400 billion in yearly uncollected taxes.

When you ration tax collectors, how can you fairly enforce the law, reduce the deficit or, heaven forbid, repair America’s streets, bridges, drinking water systems, public transit and schools?

John Adams said that, “Facts are stubborn things; and whatever may be our wishes, our inclinations, or the dictates of our passions, they cannot alter the state of facts and evidence.” The verity of our second president’s words should serve as a call to action against the “alternative facts,” lies and myths, which have already come to define the current Trump administration and pose so grave a threat to our weakened democratic society and its level of freedom and justice.

“His entire life, Trump has sold shimmer and called it silver. It was and is all an illusion, a brand built on selling banality with braggadocio. He shaped vapors into dreams and delivered them to those hungry for a taste of the showy, hollow form of the high life he came to represent. He was successful at exploiting those with an ostentatious appetite for the air of success. Trump’s life story is a pyramid scheme of ambitions.

“He took that history to a people struggling through a drought of opportunity and he exploited their weaknesses: a shrinking sense of economic security and growing nativist tendencies.

“But Trump doesn’t speak so much from facts as from feelings. For him, the truth is malleable and a lie is valuable. He creates his own reality rather than living in the reality of others. Deception is just a tool; betrayal is just an inconvenience.

The Chinese company, Anbang Insurance Group, would pay to get a high-profile piece of Manhattan real estate and would commit to spending billions more to completely transform the 60-year-old tower into a chic condominium and retail citadel.

If signed, the potential agreement would create a financial marriage of two politically powerful families in the world’s two biggest economies, but it would also present the possibility of glaring conflicts of interest. The Kushner family, owners of the tower, would reap a financial windfall courtesy of a Chinese company, even as Jared Kushner, a senior adviser to Mr. Trump as well as his son-in-law, helps oversee American foreign policy.

    In the Public Interest

“Making America Great” at Americans’ Expense

Donald J. Trump was a builder of casinos and high-priced hotels and golf courses. Now he is a builder of a tower of contradictions for the American people that is making “America Great” at their expense.
He made many conflicting promises throughout his presidential campaign. He was going to be the “voice of the people.” He was going to make their safety and their job expansion his number one priority. He was going to make sure that everybody had health insurance under his then unannounced plan. He was going to deregulate businesses, cut taxes, increase the military budget, build and repair the country’s public infrastructure and not surge the deficit. He was going to scrap the trade agreements known as NAFTA and the WTO.
Now in the White House, he proceeds to push programs and policies that contradict many of his promises. He is ballooning an already massive, bloated military budget by cutting the health and safety budgets of consumer, environmental and labor regulatory agencies and housing and energy assistance. Reportedly he wants to cut one billion dollars out of the budget of the Centers for Disease Control that works to detect and prevent global epidemics! Just today, the Congressional Budget Office announced that under the proposed Republican Health Plan, 24 million people will lose health care by 2026. Apparently he is oblivious to the perils of Avian Flu, SARS, Ebola and Zika threatening our national security and the health and lives of millions of people.
There is more to this emerging betrayal. Trump is supporting Republican Speaker of the House Paul Ryan’s “you’re on your own, folks” devastating health insurance plan. Slash and burn Ryan, comfortably fully insured by the taxpayers, publicly admits he doesn’t know how many people will lose their health insurance. Imagine the impact of strip-mining Medicaid on the poor – nearly 70 million, including many children, are on that program. Runaway Ryan even fantasizes over going after Medicare next and corporatize it.
Republicans such as Mick Mulvaney, the new director of Trump’s Office of Management and Budget, argue that these measures are necessary for “efficiency.” Yet neither Trump, nor Mulvaney, nor Ryan, nor Senate Majority Leader Mitch McConnell have ever gone after $60 billion in business fraud on Medicare each year. The Congressional Government Accountability Office’s (GAO) reports ten percent of all health care spending is drained away by computer billing fraud and abuse.=That would be about $340 billion this year alone – an estimate considered rock bottom by the nation’s leading expert on health care billing fraud – Professor Malcolm Sparrow of Harvard University!
It gets nuttier. Trump wants to increase the budget of the sprawling Department of Homeland Security but cut the budget of the US Coast Guard (which is part of the Department) and whose budget is already strapped in safeguarding our coastlines (See David Helvarg’s engrossing book, Rescue Warriors, which describes the Coast Guard’s often unsung missions).
Trump seems unwilling to oppose the more extreme “mad dogs” among the Congressional Republicans who want to erase the budgets for legal services for the poor (150 corporate law firms last week signed a letter saying they support maintaining the budget for legal services for the poor), public broadcasting and the National Endowments for the Arts and Humanities. The total number of dollars for all these programs is about $1 billion annually, or one thirteenth the cost of another redundant air craft carrier (we already have twelve in service—more active service carriers than the rest of the world combined).
Moreover, this self-touted “voice of the people” is instead placing in the highest government positions the “voices” of Wall Street billionaires. Next door to his Oval Office is Gary Cohn, former Goldman Sachs boss, a supposedly smart man who just mimicked Trump by absurdly claiming “we have no alternative but to reinvest in our military and make ourselves a military power once again.” Who in the world doesn’t think US Empire, bristling with arrays of weapons of mass destruction and able to immediately destroy far weaker adversaries in the air, on the sea and land is not a military power?
Wall Street and the mega-wealthy now run the Treasury Department, the State Department, and the Department of Education while corporatists and militarists run other major departments and agencies. Where are the people’s voices in that plutocratic park?
As the opposition coalesces in their resistance to various measures pushed by Trump’s tantrums, it is interesting to note the surprising diversity of those challenging President Trump. More than a few corporate leaders are appalled by extreme Trumpism and their opposition is not restricted to the destabilizing bill to replace Obamacare or to Silicon Valley.
Sure, corporate CEOs are tempted by the tax cuts and jettisoning of some regulations. But they know they are making record after-tax profits, record corporate after-tax pay for themselves, and the stock market is soaring. As they watch the growing rumble from the people in street demonstrations and at Congressional town meetings, there is building a little foreboding.
They’re thinking – why rock the boats (or yachts) – Trump is taking away what people already have – their health insurance – and their health and safety protections while the Republicans plan to continue depressing their vote and rigging the electoral districts by gerrymandering. When a society, blocked from advancing justice, is unraveling what fair play there remains, the corporate bosses, who see beyond tomorrow, get worried, for good reason.
The tower of contradictions, being constructed by Trump and the most extreme Republican Party in its history, won’t be camouflaged or distracted for long by provocative, prevaricating 3:00 am tweets from the White House.

Trump Promises U.S. Steel in Pipelines; A Russian Oligarch Profits

    STEVE HORN, steve [at], @SteveAHorn

Horn is an investigative journalist and writer for See his recent writing exposing many aspects of the fossil fuel industry. He recently broke the story: “Behind Trump’s Push for ‘American Steel’ in Pipelines, Another Russian Company with Putin Ties Stands to Benefit,” which states:

“In his speech at the Conservative Political Action Conference (CPAC) … President Donald Trump commemorated the one-month anniversary of his executive orders calling for the approval of the Keystone XL and Dakota Access pipelines, as well as one calling for U.S. pipelines to get their line pipe steel from U.S. facilities.

“‘I said, who makes the pipes for the pipeline?’ Trump told the CPAC crowd. ‘If they want a pipeline in the United States, they’re going to use pipe that’s made in the United States, do we agree?’

“But while the pipe may be made in the U.S., as DeSmog has shown in previous investigations, ownership tells a different story. Enter: TMK IPSCO, a massive producer of steel for U.S. oil country tubular goods (OCTG) and line pipe, and a subsidiary of TMK Group. A DeSmog investigation has found ties between TMK Group’s Board of Directors and Russian President Vladimir Putin.

“TMK Group was incorporated in 2001, and in 2008, TMK IPSCO opened its doors as a U.S. subsidiary with a heavy focus on making oilfield pipes on behalf of companies performing hydraulic fracturing (‘fracking’) techniques in the Marcellus Shale basin located in the northeast U.S. TMK IPSCO, which has said it wants to be a direct competitor of U.S. Steel Corporation in the Marcellus, also makes steel for companies doing fracking in the Bakken Shale basin, located primarily in North Dakota.

“TMK Group also has a subsidiary named TMK Completions, which manufactures ‘multi-stage completion systems and tools for both uncemented and cemented well completion designs’ for the fracking process. TMK did not respond to repeated requests for comment for this story.”

“And last weekend Trump happily ran up a federal bill of around $3 million for a trip to Mar-a-Lago where he watched the Super Bowl and dropped in on a Red Cross ball, which presumably brought his resort a hefty fee.”

This Insider Trading Case Raises Troubling Questions About Trump’s Commerce Secretary Nominee

Wilbur Ross was accused of making two suspiciously timed trades while serving on the board of an embattled mortgage company.

Wilbur Ross, Donald Trump’s pick for commerce secretary, is a legendary corporate raider who made billions of dollars buying failing companies and flipping them for a profit. But as he built his $2.5 billion fortune, Ross and his private equity firm, WL Ross & Co., have faced several lawsuits and regulatory actions accusing them of financial misconduct, including breach of fiduciary duty and fraud. His controversial business record received some scrutiny during his confirmation process. But one recent lawsuit involving Ross has garnered little attention. And it raises serious ethical questions about the business dealings of the billionaire who, if confirmed by the Senate, will be in charge of promoting job creation and economic growth.

The case, filed in a Florida federal court, involved a publicly traded mortgage company called Ocwen Financial. Ross served as a board member for the firm. In 2013 and 2014, state and federal regulators targeted the company over allegations that it engaged in a variety of improper practices. Ocwen’s stock plummeted, and shareholders suffered major losses. Its stock peaked in 2013 at about $56 per share, and the company is currently trading at about $5. But Ross managed to avoid millions in losses by off-loading his holdings in the company in two curiously timed trades that came shortly before damaging news was revealed that sent Ocwen shares into a tailspin. In the suit, shareholders accused Ross and other company directors of using inside information to enrich themselves and of leaving “ethics, integrity, and fair dealing by the wayside in their quest for ever higher revenues and thus, higher compensation and ever more lucrative incentives for themselves.”

The responsible application of science to government

Welcome! We want to thank you all for your incredible outpouring of support for this march. We are working to schedule a March for Science on DC and across the United States. We have not settled on a date yet but will do so as quickly as possible and announce it here.

Although this will start with a march, we hope to use this as a starting point to take a stand for science in politics. Slashing funding and restricting scientists from communicating their findings (from tax-funded research!) with the public is absurd and cannot be allowed to stand as policy. This is a non-partisan issue that reaches far beyond people in the STEM fields and should concern anyone who values empirical research and science.

There are certain things that we accept as facts with no alternatives. The Earth is becoming warmer due to human action. The diversity of life arose by evolution. Politicians who devalue expertise risk making decisions that do not reflect reality and must be held accountable. An American government that ignores science to pursue ideological agendas endangers the world.

Please bear with us as pull together our mission statement and further details. Many more updates to come on Monday.

Sign Here to Impeach Donald Trump Now [103,446 Total Signers as of now]

From the moment he assumed the office, President Donald Trump has been in direct violation of the US Constitution. The President is not above the law. We will not allow President Trump to profit from the presidency at the expense of our democracy.

We are calling upon Congress to pass a resolution calling for the House Committee on the Judiciary to investigate whether sufficient grounds exist for the impeachment of Donald John Trump, President of the United States.
    Why Impeachment?

The nation is now witnessing a massive corruption of the presidency, far worse than Watergate. Indeed, Nixon White House Counsel John Dean has told reporters: “I don’t think Richard Nixon even comes close to the level of corruption we already know about Trump.”[1] Given the opportunity of ten full weeks between the election and the inauguration to divest his business interests, Mr. Trump chose instead to announce, just nine days before inauguration, a wholly inadequate plan to step away from operations, but not ownership or income streams, of the Trump Organization. Instead, he has chosen to profit from the presidency at public expense, in violation of the United States Constitution. The violations, the corruption, and the threat to our republic are here now.

[1] McKay Coppins, “He Is Going to Test Our Democracy as It Has Never Been Tested,” The Atlantic, Jan. 17, 2017,
    Grounds For Impeachment

President Trump’s personal and business holdings in the United States and abroad present unprecedented conflicts of interest. Indeed, President Trump has admitted he has conflicts of interest in some cases. For example, the Trump Organization has licensing deals with two Trump Towers in Istanbul, and has received up to $10 million from developers since 2014.[1] President Trump admitted recently that “I have a little conflict of interest, because I have a major, major building in Istanbul.”[2]

Crucially, some of these business arrangements violate the U.S. Constitution’s Foreign Emoluments Clause, which provides: “[N]o Person holding any Office of Profit or Trust under [the United States], shall, without the Consent of the Congress, accept of any present, Emolument, Office, or Title, of any kind whatever, from any King, Prince, or foreign State.”[3] The purpose of this provision is to prevent foreign influence or corruption. “Emoluments” from foreign governments include “any conferral of a benefit or advantage, whether through money, objects, titles, offices, or economically valuable waivers or relaxations of otherwise applicable requirements,” even including “ordinary, fair market value transactions that result in any economic profit or benefit to the federal officeholder.”[4]

Many of the Trump Organization’s extensive business dealings with foreign governments, businesses owned by foreign governments, and other foreign leaders violate this ban. A recent legal analysis by Prof. Laurence Tribe of Harvard Law School, Ambassador (ret.) Norman Eisen (former chief ethics counsel to President Barack Obama), and Professor Richard Painter (former chief ethics counsel to President George W. Bush) concluded that Mr. Trump would be violating the foreign emoluments ban from the moment he took office, due to “a steady stream of monetary and other benefits from foreign powers and their agents” deriving from his existing business arrangements.[5] As a result, since he did not divest his business operations before inauguration, he has been violating the Foreign Emoluments Clause since the moment he took office.[6]

Examples of existing business arrangements that constitute violations of the Foreign Emoluments Clause include:

    >Trump’s business partner in Trump Tower Century City (Manila, Philippines) is Century Properties. (Trump is not the developer; he has a brand licensing contract.) The head of Century Properties is Jose Antonio, who was just named special envoy to the United States by the president of the Philippines.[7] Payments from a company owned by a foreign government official are foreign emoluments.

    >China’s state-owned Industrial and Commercial Bank of China is the largest tenant in Trump Tower. It is also a major lender to Trump.[8] Both its regular rent payments, and its ongoing extension of credit, are foreign emoluments.

    >Foreign diplomats have already begun shifting their D.C. hotel and event reservations to Trump International Hotel, to curry favor or at least avoid insulting the president.[9] Indeed, the Embassy of Kuwait was reportedly pressured by the Trump Organization to change an existing reservation and reschedule the event at the Trump International.[10] Payments by foreign diplomats for lodging, meeting space, or food at the hotel are foreign emoluments.

Similarly, the Constitution’s Domestic Emoluments Clause (also known as the Presidential Compensation Clause) provides: “The President shall, at stated Times, receive for his Services, a Compensation, which shall neither be encreased nor diminished during the Period for which he shall have been elected, and he shall not receive within that Period any other Emolument from the United States, or any of them.”[11] This provision, which is not waivable by Congress, is designed to prevent corruption, as Alexander Hamilton explained:

“Neither the Union, nor any of its members, will be at liberty to give, nor will he be at liberty to receive, any other emolument than that which may have been determined by the first act. He can, of course, have no pecuniary inducement to renounce or desert the independence intended for him by the Constitution.”[12]

President Trump has chosen to continue owning businesses that receive government subsidies and tax breaks in violation of this provision. For example, since 1980, Mr. Trump and his businesses have “reaped at least $885 million in tax breaks, grants and other subsidies for luxury apartments, hotels and office buildings in New York.”[13] As President, federal and state subsidies and tax breaks violate the Domestic Emoluments Clause.

Furthermore, as noted above, “emoluments” are not limited to monetary payments; they also include economically valuable favorable regulatory actions. President Trump’s control over the vast modern powers of the executive branch means that regulatory action affecting his businesses favorably constitutes an “Emolument from the United States.” For example, President Trump’s ongoing lease of Washington, D.C.’s Old Post Office, in which the Trump International Hotel is located, violates an explicit clause in the General Services Administration lease contract providing: “No . . . elected official of the Government of the United States . . . shall be admitted to any share or part of this Lease, or to any benefit that may arise therefrom . .. .”[14] In late November, members of Congress wrote the GSA requesting information about the “imminent breach-of-lease and conflict of interest issues created by President-elect Donald Trump’s lease with the U.S. Government for the Trump International Hotel building in Washington, D.C.”[15] The GSA responded in mid-December that it could not make a determination “until the full circumstances surrounding the president-elect’s business arrangements have been finalized and he has assumed office.”[16] His business arrangements have been announced (not including any divestment of the hotel) and he has assumed office, but the GSA is not pursuing any legal action to enforce the provision. That favorable regulatory treatment provides President Trump a significant financial benefit from the federal government above and beyond his federal salary.

Finally, the Committee should also investigate whether President Trump is violating the the Stop Trading on Congressional Knowledge Act of 2012 (STOCK Act). The STOCK Act is one of the few federal ethics statutes that specifically includes the President. Among other provisions, it prohibits the President from (1) using nonpublic information for private profit, and from (2) intentionally influencing an employment decision or practice of a private entity solely on the basis of partisan political affiliation.[17]

Washington, DC—Citizens for Responsibility and Ethics in Washington (CREW) is bringing a federal lawsuit to stop President Trump from violating the Constitution by illegally receiving payments from foreign governments. The lawsuit will be filed in the Southern District of New York when the court opens at 9 AM on Monday.

The foreign emoluments clause of the Constitution prohibits Trump from receiving anything of value from foreign governments, including foreign government-owned businesses, without the approval of Congress.

“We did not want to get to this point. It was our hope that President Trump would take the necessary steps to avoid violating the Constitution before he took office,” CREW Executive Director Noah Bookbinder said. “He did not. His constitutional violations are immediate and serious, so we were forced to take legal action.”

Since Trump refused to divest from his businesses, he is now getting cash and favors from foreign governments, through guests and events at his hotels, leases in his buildings, and valuable real estate deals abroad. Trump does business with countries like China, India, Indonesia and the Philippines, and now that he is President, his company’s acceptance of any benefits from the governments of those countries violates the Constitution. When Trump the president sits down to negotiate trade deals with these countries, the American people will have no way of knowing whether he will also be thinking about the profits of Trump the businessman.

“President Trump has made his slogan ‘America First,’” said Bookbinder. “So you would think he would want to strictly follow the Constitution’s foreign emoluments clause, since it was written to ensure our government officials are thinking of Americans first, and not foreign governments.”

CREW is represented in the case by an all-star team of top constitutional scholars, ethics experts and litigators who have combined to argue 45 cases before the Supreme Court. The lawyers on the case include CREW’s board chair and vice-chair Norman Eisen and Richard Painter, the top ethics lawyers for the last two presidents, Constitutional law scholars Erwin Chemerinsky, Laurence H. Tribe and Zephyr Teachout, and Deepak Gupta of Gupta Wessler PLLC.

How to Legally Declare Someone as Mentally Incompetent?

Written by S. Arteta and Fact Checked by The Law Dictionary Staff

In the United States, competency involves the mental capacity of an individual in order to participate in a legal proceeding or his ability to exercise his liberty and pursue his interest. Competence also pertains to the capability of an individual’s state of mind to make decisions that involve his interests.

Competency is presumed unless there exists a reason to declare a person as mentally incompetent. There are several factors that would affect an individual’s competency to make a particular decision, a particular contractual agreement, to execute an effective deed to real property, or to execute a Will.

The steps in declaring an individual as mentally incompetent are as follows:

    1. File a form to declare a person as an incompetent before the Probate Court having jurisdiction over the area where the subject of the petition resides. This form shall include an application to be declared as court appointed guardian.

    2. In filing the petition, the aid of a mental health or guardianship lawyer is beneficial to the petitioner. The retained counsel shall assist the petitioner in the gathering of supporting documents or evidence to strengthen your petition.

    3. There must be a psychological evaluation of the person subject of the petition to be conducted by a medical practitioner. If the person sought to be declared as incompetent does not comply with a voluntary evaluation, a court order must be requested, by way of filing the proper motion, before the probate court.

    4. The result of the psychological evaluation must be submitted with the application form to the Probate Court which shall proceed to determine whether or not there is sufficient ground to declare the subject as incompetent. The Probate Court shall also determine whether or not the person seeking to be appointed as guardian is suitable. The petitioner may be required by the court to post a bond with the help of financial insurance companies. The posting of the bond is required for the purpose of protecting the property and other interests of the individual sought to be proclaimed as incompetent.

    5. Petitioners may have some difficulty in looking for bonding companies or insurance companies that may post bond for him. This may be due to poor credit history or criminal history. Here, your guardianship lawyer may be of help.

    6. If the subject of the petition is an adult, the petitioner must contact the adult protective services which shall conduct an investigation. This is mandatory even if the petitioner does not seek to be appointed as a guardian

The Engineering of Consent: “how those in power have used Freud’s theories to try and control the dangerous crowd in an age of mass democracy”

Th UK-Based Australian journalist and filmmaker John Pilger writes:

The American journalist, Edward Bernays [] is often described as the man who invented modern propaganda.

The nephew of Sigmund Freud, the pioneer of psycho-analysis, it was Bernays who coined the term “public relations” as a euphemism for spin and its deceptions.

In 1929, he persuaded feminists to promote cigarettes for women by smoking in the New York Easter Parade – behaviour then considered outlandish. One feminist, Ruth Booth, declared, “Women! Light another torch of freedom! Fight another sex taboo!”

Bernays’ influence extended far beyond advertising. His greatest success was his role in convincing the American public to join the slaughter of the First World War. The secret, he said, was “engineering the consent” of people in order to “control and regiment [them] according to our will without their knowing about it”.

He described this as “the true ruling power in our society” and called it an “invisible government”.

Today, the invisible government has never been more powerful and less understood. In my career as a journalist and film-maker, I have never known propaganda to insinuate our lives and as it does now and to go unchallenged.

Imagine two cities. Both are under siege by the forces of the government of that country. Both cities are occupied by fanatics, who commit terrible atrocities, such as beheading people.

But there is a vital difference. In one siege, the government soldiers are described as liberators by Western reporters embedded with them, who enthusiastically report their battles and air strikes. There are front page pictures of these heroic soldiers giving a V-sign for victory. There is scant mention of civilian casualties.

In the second city – in another country nearby – almost exactly the same is happening. Government forces are laying siege to a city controlled by the same breed of fanatics.

The difference is that these fanatics are supported, supplied and armed by “us” – by the United States and Britain. They even have a media centre that is funded by Britain and America.

Another difference is that the government soldiers laying siege to this city are the bad guys, condemned for assaulting and bombing the city – which is exactly what the good soldiers do in the first city.

Confusing? Not really. Such is the basic double standard that is the essence of propaganda. I am referring, of course, to the current siege of the city of Mosul by the government forces of Iraq, who are backed by the United States and Britain and to the siege of Aleppo by the government forces of Syria, backed by Russia. One is good; the other is bad.

What is seldom reported is that both cities would not be occupied by fanatics and ravaged by war if Britain and the United States had not invaded Iraq in 2003. That criminal enterprise was launched on lies strikingly similar to the propaganda that now distorts our understanding of the civil war in Syria.

Without this drumbeat of propaganda dressed up as news, the monstrous ISIS and Al-Qaida and al-Nusra and the rest of the jihadist gang might not exist, and the people of Syria might not be fighting for their lives today.

Some may remember in 2003 a succession of BBC reporters turning to the camera and telling us that Blair was “vindicated” for what turned out to be the crime of the century. The US television networks produced the same validation for George W. Bush. Fox News brought on Henry Kissinger to effuse over Colin Powell’s fabrications.
